International Comparison

Introduction

Australia and the USA have a common heritage obtained from England, their mother country. It is, therefore, not surprising that the criminal justice systems in the two nations strike similarities in many aspects. Some of the areas where they compare include crime investigation, finding facts for trial as well as the fairness that is required for a just legal procedure. However, there are also some notable differences in the various aspects. Specifically, the two countries hold divergent views on what limits law enforcement action can reach, admissibility of proof in criminal procedures as well as the roles of an attorney and the jury are strikingly different (Dammer & Albanese, 2013). This paper will address the similarities and differences in the criminal justice systems between the two countries.

Substantive Law While the two countries have almost similar substantive laws given their common origin, there are some basic differences in their application. For example, Australia, a Monarchy, is headed by the High Court, which is the final court of appeal. The court has the final say on matters concerning interpretation on statutes. The High court has developed the “Common Law of Australia,” which applies across all territories of the country (Chisholm & Nettheim, 2012).
